Government investigations are often dependent upon digital data and, in particular, digital personal data.  Imbalances in access to that data between investigator and defense counsel can cause fundamental unfairness to those being investigated.  This unfairness can be severely compounded by needs for cross-border discovery of digital data.   This session explores a few critical issues that impact the balances between the state and the individual.
